Terms & Conditions of Road Carriage

1. Incorporation of Terms & Scope

All goods carried by APEX Logistics UK Ltd ("the Carrier") are accepted and transported strictly in accordance with these Conditions of Carriage and the Road Haulage Association (RHA) Standard Conditions of Carriage (Latest Edition), which are incorporated into every contract of transport.

In the event of any conflict between these express terms and the RHA conditions, these express conditions shall prevail to the extent of such inconsistency.

2. Customer Obligations & Cargo Warranties

The Customer (whether Sender, Consignor, or Broker) expressly warrants that:

  • They are either the lawful owner of the consignment or have full authority from the owner to contract for its carriage.
  • All goods are properly packaged, labelled, and protected to withstand the ordinary risks of road transit in a light commercial vehicle (3.5T).
  • The cargo does not contain illegal contraband, hazardous materials (ADR class 1-9 unless agreed in advance), toxic chemicals, livestock, or stolen property.
  • Accurate weight, dimensions, and handling instructions have been declared prior to dispatch.

3. Liability Limits & Goods in Transit Cover

Unless an enhanced bespoke declaration has been approved in writing prior to dispatch:

£100,000 Goods in Transit Standard Cover

The Carrier maintains comprehensive all-risks Goods in Transit insurance underwritten by Aviva Insurance UK with a standard indemnity limit of £100,000 per vehicle load for loss or physical damage occurring in direct transit.

Under standard RHA formula limits, liability is computed at £1,300 per metric tonne of gross weight lost or damaged, whichever is applicable under the policy endorsement.

4. Electronic Proof of Delivery (ePOD) & Handover

Delivery is deemed fully complete when the consignment is presented at the designated destination address and an electronic signature or Photographic Proof of Delivery (ePOD) is captured by the Carrier's driver.

The Carrier shall not be liable for non-delivery or demurrage resulting from absent consignees, blocked access gates, or refusal of delivery, provided reasonable efforts were made by the driver.

5. Claims Notification Procedure

Any claim against the Carrier for physical damage or loss must be lodged in writing:

  • Visible Damage or Shortage: Must be recorded on the ePOD upon handover and confirmed in writing within 3 business days.
  • Non-Delivery or Total Loss: Must be reported in writing within 14 calendar days of the booked transit date.

Claims should be submitted via email to dispatch@apexlogistics.co.uk accompanied by the consignment note reference (AWB) and photographic evidence.

6. Payment Terms & Demurrage

Payment for spot-booked transport is due upon confirmation unless an approved 30-day B2B Trade Credit Account has been established. Invoices overdue beyond 30 days are subject to statutory interest under the Late Payment of Commercial Debts (Interest) Act 1998 at 8% above the Bank of England base rate.

Loading and unloading allow for 30 minutes free time at collection and destination. Waiting time beyond 30 minutes is charged at £30.00 + VAT per hour in 15-minute increments.

7. Governing Law & Jurisdiction

These conditions and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction.
